These Terms of Service define the terms and conditions for using the diet support app calomee (hereinafter referred to as "this Service") provided by the service provider. Users (hereinafter referred to as "Users") are deemed to have agreed to these Terms by using this Service.

Article 1: Application

  1. These Terms apply to all relationships between the service provider and Users regarding the use of this Service.

  2. Various guidelines and other materials posted by the service provider on this Service from time to time shall constitute part of these Terms.

Article 2: User Registration

  1. Those wishing to use this Service shall apply for user registration by the method specified by the service provider, and registration is completed when the service provider approves the application.

  2. Use of this Service is limited to Users aged 9 years and older. Minors must obtain parental consent before using the Service.

  3. The service provider may not approve registration if the applicant falls under any of the following:

    • When false information is provided

    • When the application is from a person who has violated these Terms

    • When the service provider otherwise determines that registration is not appropriate

Article 3: Plan Categories

  1. This Service offers the following plans:

    • Free Plan

    • Free Trial Plan (7 days only upon initial registration)

    • Paid Subscription Plan (monthly or annual)

  2. The features available for each plan shall be separately determined by the service provider and displayed on this Service.

Article 4: Paid Plans

  1. The usage fees, payment methods, and billing start date for paid subscription plans shall be in accordance with the terms of the App Store operated by Apple Inc.

  2. Subscriptions will be automatically renewed unless Users cancel.

  3. Paid usage fees will not be refunded except as required by law.

Article 5: Free Trial

  1. This Service offers a 7-day free trial plan only upon initial registration.

  2. After the free trial period ends, the plan will automatically transition to the free plan.

  3. The terms, duration, etc. of the free trial may be changed or terminated at the service provider's discretion.

Article 6: Advertising

  1. Advertisements may be displayed within this Service on the free plan.

  2. Advertisements will not be displayed on paid subscription plans.

  3. Third-party advertising delivery services are used for advertising delivery, and these services may collect user information based on their own privacy policies.

Article 7: Health-Related Information

  1. Advice, comments, etc. provided in this Service are general information intended for health support and do not replace medical treatment or guidance by physicians, registered dietitians, or other specialists.

  2. Some of the advice provided in this Service is automatically generated by AI (artificial intelligence) and does not necessarily guarantee accuracy or completeness.

  3. The automatic analysis function for food images provided in this Service is an AI-based estimate and may differ from actual nutritional values. Please check food labels and other sources when accurate nutritional information is needed.

  4. Users shall use this Service at their own responsibility, and if they have health concerns, they must consult specialists such as physicians.

Article 8: Prohibited Acts

Users shall not engage in the following acts:

  • Acts that violate laws and regulations or public order and morals

  • Attempts to gain unauthorized access or misuse the Service

  • Acts that interfere with the operation of the Service

  • Posting images or content that infringe on the rights of others

  • Other acts that the service provider deems inappropriate

Article 9: Account Suspension/Deletion

  1. The service provider may suspend or delete an account without prior notice if a User falls under any of the following:

    • When these Terms are violated

    • When there has been no use for an extended period (more than 2 years since the last login)

    • When it is discovered that registration information is false

    • When the service provider otherwise deems it inappropriate

  2. During account suspension, all or part of the use of this Service will be restricted.

  3. Data recovery after account deletion will not be performed in principle.

Article 10: Disclaimer

  1. The service provider does not guarantee that this Service is free from defects in fact or law.

  2. The service provider shall not be liable for damages incurred by Users through the use of this Service, except in cases of intentional or gross negligence by the service provider.

  3. The service provider shall not be liable if the provision of this Service becomes difficult due to natural disasters, communication line failures, or other force majeure events.

Article 11: Changes to Terms

  1. The service provider may change these Terms when deemed necessary.

  2. When making significant changes, the service provider will notify Users of the changes on this Service (in-app notification or email). Users are responsible for registering an accurate email address.

  3. If Users use this Service after the changes, they will be deemed to have agreed to the revised Terms.

Article 12: User-Posted Content

  1. Copyright of content posted by Users to this Service (meal records, food images, etc.) belongs to the Users.

  2. Users grant permission for the service provider to use (reproduce, display, transmit, AI analysis, etc.) posted content to the extent necessary for providing this Service.

  3. Users shall not post content that infringes on the rights of third parties.

Article 13: Intellectual Property Rights

  1. Intellectual property rights for content, designs, logos, trademarks, etc. included in this Service belong to the service provider or legitimate rights holders.

  2. Users may not reproduce, repost, distribute, publicly transmit, etc. these without prior written permission from the service provider.

Article 14: Withdrawal

  1. Users may withdraw at any time by the method specified by the service provider.

  2. After withdrawal, the User's account information and registration data will be deleted. However, information required to be retained by law is excluded.

  3. If a User subscribed to a paid subscription plan withdraws, paid usage fees will not be refunded.

Article 15: Service Suspension/Termination

  1. The service provider may suspend or interrupt the provision of all or part of this Service in the following cases:

    • When performing system maintenance or inspection

    • When provision becomes difficult due to force majeure such as natural disasters

    • When the service provider otherwise deems it necessary

  2. When terminating the Service, the service provider will make efforts to notify Users in advance whenever possible.

  3. The service provider shall not be liable for damages incurred by Users due to the preceding paragraphs.

Article 16: Governing Law/Jurisdiction

  1. These Terms shall be governed by Japanese law.

  2. In the event of a dispute regarding this Service, the Tokyo District Court shall be the exclusive agreed jurisdiction.
